Civil Procedure
Jurisdiction, Erie, preclusion, discovery, and trial motions as they appear in short facts.
The Multistate Bar Examination is a full-day multiple-choice test written by the NCBE. It covers seven subjects. Most jurisdictions pair it with written components; this page is only the MBE slice.
The seven MBE subjects are Civil Procedure, Constitutional Law, Contracts, Criminal Law and Procedure, Evidence, Real Property, and Torts. Items are fact patterns. You are choosing the best legal conclusion, not restating a hornbook heading.
The National Conference of Bar Examiners publishes the current subject-matter outline. Use that outline, not a memory of an older bar review lecture, to decide what still belongs in the deck. Written MEE/MPT work is a separate daily block and should not share this element deck.
Jurisdiction, Erie, preclusion, discovery, and trial motions as they appear in short facts.
Justiciability, equal protection, due process, speech, and federalism questions with a precise level of scrutiny.
Contracts, torts, and property: formation, defenses, estates, and recording problems.
Elements, Fourth/Fifth/Sixth Amendment timing, hearsay exclusions, and character rules.
For a graduate who has finished bar-review lectures or is watching them in parallel. Written practice should take its own hours.
Weeks 1–4
Turn each subject’s high-frequency rules into element cards. If you cannot list the elements without the outline, the card is not done.
Weeks 5–8
Do mixed MBE sets before rereading. Card the distinction you missed — invited error versus harmless error, not the whole lecture.
Weeks 9–10
Sit longer mixed blocks so the afternoon slump is familiar. Reviews stay. New rules should be rare.
An MBE card should end in a decision: admissible or not, specific performance or damages, public forum or not. Outlines that only define “consideration” will feel productive and still lose questions that turn on a distinction.
Spaced repetition keeps elements available while you spend expensive hours on mixed sets. It cannot replace those sets. The calculator assumes several hundred distinction cards, not a restated commercial outline.
Name the claim, then list elements with your eyes closed before you flip.
Put two close rules on one card and ask which fact changes the result.
Walk exclusion, exception, and residual in order — stop at the first that applies.
600 element and distinction cards at 50 minutes a day for ten weeks. Mixed question blocks sit outside this budget.
Estimate: 30 seconds per new card, 10 seconds per review. Fixed review gaps, not FSRS or a recall prediction.
Your calculator inputs stay in this browser tab. No uploads, email or signup needed.
No. It is the MBE multiple-choice slice. Essays and performance tests need timed writing of their own.
Enough mixed, timed sets that the seven subjects rotate under fatigue. A fixed magic number is less useful than a weekly mix you actually review.
Card the distinctions that keep costing you questions. A commercial outline copied into cards will not finish.
The MBE is a uniform NCBE test. Whether your jurisdiction uses it, and what it pairs with, is a local bar-admission rule.
